These Terms & Conditions (“Terms”) govern the access and use of the [App Name] mobile application and platform (“Platform”), operated by Dappinity Technologies Pvt Ltd , a company incorporated under the laws of India, having its registered office at Faridabad, Haryana (“Company / We / Us”).
By accessing, registering on, or using the Platform, you agree to be bound by these Terms.
1. Definitions
User / Caller / General User– Any person using the Platform to place calls and consume services.
Expert / Partner / Professional – A professional or service provider registered on the Platform to receive calls.
Wallet – A prepaid balance maintained on the Platform for calls.
Call – A voice or video interaction between a User and an Expert via the Platform.
Platform Fee – The fee retained by the Company from each call.
GST – Goods and Services Tax applicable under Indian law.
2. Nature of the Platform
2.1 The Platform acts as a technology intermediary facilitating paid calls between Users and Experts.
2.2 The Company does not provide professional advice and does not guarantee outcomes, accuracy, or completeness of information provided by Experts.
2.3 Experts are independent service providers, not employees or agents of the Company.
3. User Eligibility
3.1 You must be 18 years or older to use the Platform.
3.2 By registering, you confirm that all information provided is accurate and complete.
3.3 The Company reserves the right to suspend or terminate accounts providing false or misleading information.
4. Wallet, Payments & GST
4.1 Wallet Top-Ups
Users may add money to their wallet through supported payment methods.
Wallet balances are prepaid and non-interest bearing.
4.2 GST on Wallet Top-Ups
GST is charged at applicable rates (currently 18%) on wallet top-ups.
Wallet balance reflects only the GST-exclusive value.
GST collected is a statutory liability and is not usable wallet balance.
Example:
If you pay ₹118, your wallet balance will be ₹100 and ₹18 will be GST.
4.3 Use of Wallet Balance
Wallet balance can only be used for calls on the Platform.
Wallet balance cannot be transferred between users or converted to cash.
5. Call Charges & Settlement\
5.1 Calls are charged based on:
Duration of the call
Per-minute rate set by the Expert
5.2 Call charges are deducted from the User’s wallet upon completion of the call.
5.3 The Company:
Collects the full call amount from the User
Pays the Expert their net earning
Retains a Platform Fee
5.4 No GST is charged again on calls, as GST is already paid at the wallet top-up stage.
6. Experts & Earnings
6.1 Experts set their own call rates, subject to Platform policies.
6.2 Experts are paid their net earnings after deduction of Platform Fee.
6.3 Experts are responsible for:
Their own taxes
Compliance with applicable laws
Accuracy of information provided
6.4 The Company may withhold payouts in cases of fraud, dispute, or policy violation.
7. Refunds & Cancellations
7.1 Wallet Refunds
Wallet top-up refunds may be issued at the Company’s discretion.
GST refunds, if applicable, will follow statutory compliance rules.
7.2 Call-Related Refunds
Call refunds may be issued in cases such as:
Technical failure
Incomplete calls due to system issues
Platform Fee and Expert payout may be reversed accordingly.
8. User Conduct
Users agree not to:
Misuse or abuse Experts
Harass, threaten, or engage in inappropriate behavior
Attempt to bypass Platform payments
Record calls without consent (where prohibited by law)
Violations may result in immediate suspension or termination.
9. Expert Verification & Badges
9.1 The Platform may display verification badges based on documents or information submitted by Experts.
9.2 Verification indicates document review only, not endorsement or guarantee of expertise.
10. Intellectual Property
10.1 All content, trademarks, logos, and software on the Platform are owned by or licensed to the Company.
10.2 Users may not copy, modify, or distribute Platform content without permission.
11. Limitation of Liability
The Company shall not be liable for:
Advice or opinions shared by Experts
Losses arising from reliance on calls
Technical interruptions beyond reasonable control
Maximum liability, if any, shall not exceed the amount paid by the User for the specific call in dispute.
12. Indemnification
Users and Experts agree to indemnify and hold the Company harmless from any claims arising out of:
Misuse of the Platform
Violation of these Terms
Violation of applicable laws
13. Account Suspension & Termination
The Company reserves the right to suspend or terminate accounts:
For policy violations
For fraudulent activity
For legal or compliance reasons
Outstanding balances may be withheld pending investigation.
14. Amendments
The Company may modify these Terms at any time.
Updated Terms will be effective upon publication on the Platform.
15. Governing Law & Jurisdiction
These Terms shall be governed by the laws of India.
Exclusive jurisdiction:
Courts at Faridabad, Haryana, India
