50% school fees waiver PIL is dismissed
PIL for 50% school fees waiver:Â
A PIL was filed in Bombay high court for a 50% school fees waiver. It was filed by a social activist. It was said in PIL that the parents are in bad economic condition. Thus the school fees shall be waived off by 50%. But the court rejected this PIL.Â
Reasons for Rejection:
The first reason for rejection was that no School was made a party in PIL. Court cant gives an order against any school unless they are a party. It is a breach of the principle of natural justice to give a verdict without listening to a party.
Although the court may consider the option to include the schools as a party. But why the applicant has ignored it. This fact is not mentioned.
The second reason is that there is a general statement made by the PIL petitioner that parents of school-going children are in financial distress.
If at all the statement is correct, nothing prevents such parents to approach the Government in a group and seek framing of guidelines for reducing the quantum of tuition fees as well as for other relief during the period of lockdown considering their plight.
I hope a PIL better drafted can be filed again. But it is hard to find out a legal remedy.
