The account of Doctor Liver is banned by the court for posting defamatory content against Himalaya Wellness. The appellant told the court that the purpose of all those posts was to push the products of competitors. They requested In the facts and circumstances issue an ad-interim exparte temporary injunction order restraining Defendant No.1 from tweeting, making or publishing, re-tweeting and republishing defamatory remarks against the plaintiff company and / or the products of the plaintiff company till the next date of hearing.
Their plea was that Defendant No.1 was posting derogatory statements and materials against the products of the plaintiff company and due to the said act of the Defendant No.1 the business of the plaintiff company was substantially reduced. According to him, the said statements and materials posted in Twitter (hosted by Defendant No.2) are perse false and not justified.
According to him, the practice of Defendant No.1 in making such publication is nothing but cut throat
competition with the products of the plaintiff company with sole intention to push the products of
the Cipla and Alchem are promoted
