The gaming sector finds itself in a state of anticipation as it awaits a review of the 28% goods and services tax (GST) imposed last October. However, the path to this review is riddled with complexities, especially considering the ongoing transition to a new central government.

Delayed Review Amidst Transition

Originally scheduled for review by the federal GST Council in March, the meeting has been postponed until June due to scheduling constraints. This delay adds to the uncertainty surrounding the gaming sector’s taxation framework.

Impact of Election Commission’s Actions

Adding to the complexity is the impending announcement of Lok Sabha election dates by the Election Commission of India. This announcement triggers the election code of conduct, which prohibits major policy decisions, further delaying the GST review.

Background and Review Process

The decision to review the 28% tax on online gaming and casinos was made during the 51st GST Council meeting in August 2023. Initially set for March 31, 2023, the review requires participation from member states and the GST secretariat.

Meeting Procedures and Composition of the GoM

GST Council meetings must be communicated to members at least seven days in advance, with provisions for emergency meetings. Additionally, the reconstituted Group of Ministers (GoM) on GST rate rationalization, chaired by Uttar Pradesh Finance Minister Suresh Kumar Khanna, includes members from various states to address variations in tax slabs.
