The urgent hearing of the application was conducted from my residence through Video conferencing Via the CISCO WEBEX meeting, vide Office Order No. 256/RG/DHC/2021 dated 08.04.2021 and 19.04.2021 of Hon’ble Court of Delhi.

PROCEEDINGS HELD THROUGH VIDEO CONFERENCING.

The present application has been filed by the IO for releasing the Oxygen Concentrator in the present FIR.

It is submitted in the application that on 04.05.2021, twelve Oxygen Concentrators were seized from the accused persons Vinay Agarwal & Akash Vashist and all of them were deposited in Police Station Dwarka Malkhana. It is also submitted in the application that many police personnel is suffering from Covid-19 and therefore, these Oxygen concentrators can be used for saving the life of the police personnel.

Ld. APP submitted that the seized Oxygen Concentrators be released in the best interest.

In the present FIR, the police have seized the 12 Oxygen Concentrators. No useful purpose would be solved to retain the Oxygen Concentrators in the police Malkhana and the same should be circulated back for the use of needy patients.

In this regard, it is pertinent to mention that judicial officers, due to their nature of work are also exposed to deadly coronavirus. A large number of judicial officers and their families in Delhi are infected with the COVID-19 virus and unfortunately two members of the Delhi Judiciary manely Ld family Judge Sh. Kovai Venugopal and Ld Metropolitan Megistrate, Dwarka Sh. Kamran Khan has lost their lives due to COVID infection.

Ergo, in the best health interest of police officer, judicial officers, and their family members, this court deems it fit to release and put to immediate use, the 12 Oxygen Concentrators be released in the following manner:
