Important update on STBA Vs UOI on GSTR 9,9C due date
GSTR 9,9C due date:
Court initially said that govt has the right to extend or not to extend and since already extended, we would not like to interfere at this stage. On appraising court that people are facing lots of technical difficulties and that from tomorrow portal shall levy late fees, on which court issued notice to GST and also said that if matter is decided in STBA’s favour, government will have to refund late fees.
TODAY 07/02/2020 DELHI HIGH COURT IN STBA MATTER
Civil Misc Application No.CM 5150/2020 was filed in the pending writ petition relating to system glitches titled Sales Tax Bar Assn. vs UOI & Ors [WP(c)No.9575/2017],due to the difficulties faced by the members & the Tax Professionals in filing of GST Form 9 & 9C and for seeking directions from the Hon’ble Delhi High Court to get its time of filing extended.
The Hon’ble Court today assembled late and was also to rise early. However,the matter was therefore, mentioned by Mr. Puneet Agrawal, counsel and the Court issued notice to the Respondents(accepted thru their Counsels) on our application and also gave directions to the Respondents, to consider the representation of the Petitioner and see the feasibility of extending the date of filing Return forms. The matter be listed with the main petition for which the next date of hearing already stands fixed for 20/02/2020.
